A settlement that is on a terraformed area or marked with signs or walls is fully owned by the person who started it. That person decides who can build in the settlement and can modify all the builds (as long as he/she doesn't steal people's goods). The settlement owner can also remove ugly or abandoned builds for example.
In a settlement that is just a group of builds near each other in natural terrain, every build is owned by their builders. No one owns that kind of settlement.
